National Business Agent Jeff Beaton has settled a class action grievance related to management's failure to perform required custodial work at the plant and stations during fiscal year 2015.
The settlement awards $155,000 to be distributed to custodians named by the Omaha Area Local.
Approximately 40 custodians who worked during fiscal year 2015 will receive a share of the award.
Management violated the following T-5 regulation by failing to complete required custodial work during FY 2015.
By rule, management is required to complete 90% of all work hours in a facility within a fiscal year.
If not then management is required to pay for all hours not work as required.
Management has failed to perform the required custodian work hours since the inception of the new TL-5 regulations.
As such, the Omaha Area Local has been awarded any hours below 100% of the work hours listed on line H of those facilities during the fiscal year.
The local recognizes steward Todd Kessler for his excellent work in developing and processing this grievance.
